These Terms of Service (“Terms”) govern the access and use of heavyequipment.tanelly.com (the “Platform”), operated by Tanelly. This Platform facilitates the listing, rental, and sale of industrial machinery and heavy equipment.

1. Scope of Service

Tanelly provides a digital marketplace for heavy machinery (e.g., excavators, cranes, loaders). We act as an intermediary platform connecting equipment owners (“Suppliers”) with users (“Renters” or “Buyers”).

2. Equipment Condition & Safety

  • “As Is” Disclaimer: All equipment is listed by third-party suppliers. While Tanelly requires suppliers to provide accurate maintenance logs, all equipment is provided on an “as-is” and “where-is” basis.

  • Safety Compliance: The Renter/Buyer is solely responsible for ensuring that all equipment is operated by certified personnel in compliance with local occupational health and safety (OHS) regulations.

  • Inspection: Users are entitled and encouraged to perform a physical inspection of the machinery prior to the commencement of any rental or purchase agreement.

3. Rental and Leasing Terms

  • Operational Hours: Rental rates are typically based on a standard 8-hour workday or 40-hour work week. Excess usage may result in additional “overtime” charges.

  • Mobilization: Unless otherwise stated, the costs of mobilization (delivery) and demobilization (pickup) of equipment are the responsibility of the Renter.

  • Fuel and Maintenance: The Renter is responsible for daily maintenance (fluids, greasing, tire pressure) and fuel costs during the rental period. Major mechanical failures not caused by operator negligence remain the responsibility of the Supplier.

4. Liability and Insurance

  • Damage Waiver: Renters may be required to provide proof of “All Risk” insurance or purchase a Damage Waiver through the Platform.

  • Indemnification: Tanelly shall not be liable for any site accidents, property damage, or personal injury resulting from the operation of equipment sourced through the Platform.

  • Force Majeure: Neither party shall be liable for delays caused by extreme weather, natural disasters, or government-imposed restrictions that prevent the transport or operation of heavy machinery.

5. Booking and Payments

  • Security Deposit: A refundable security deposit may be required for high-value machinery to cover potential minor damages or late returns.

  • Cancellation: Cancellations made within 48 hours of the scheduled mobilization date may be subject to a cancellation fee to cover logistics costs already incurred.

6. Prohibited Use

Users agree not to:

  1. Sub-lease the equipment to any third party without prior written consent from the Supplier.

  2. Operate the equipment outside of the agreed-upon geographic territory.

  3. Use the equipment for tasks that exceed the manufacturer’s rated capacity.

7. Intellectual Property

All technical specifications, manuals, and media (photos/videos) provided on the Site are protected by copyright. You may not use these materials for commercial purposes outside of your transaction on this Platform.

8. Data Privacy

Tanelly collects and processes business data and operator certifications in accordance with our [Privacy Policy]. We may share your contact details with logistics partners to facilitate equipment delivery.

9. Governing Law
